Broadmoor scraps plan to expand golf courses

The Broadmoor has decided against an expansion of its golf course.

The Broadmoor has dropped a proposal to expand its west and east golf courses after neighbors of the Colorado Springs resort objecting to closing a potential evacuation route, The Gazette reports.

Under an idea the resort first floated in May, The Broadmoor would have to close part of Cheyenne Mountain Boulevard to create one large course and enable the resort to attract more elite golf touranments.

The Broadmoor reached out to neighboring residents for their opinion on the proposal. What came back were concerns closing Cheyenne Mountain Boulevard could get in the way if an evacuation was needed to escape a wildfire.

Denver financier Phil Anschutz owns The Broadmoor.

(AP) ? San Francisco Bay Area commuters got a reprieve from a potential transit strike when a judge on Sunday granted California Gov. Jerry Brown's request for a 60-day cooling-off period in negotiations between the Bay Area Rapid Transit Agency and two of its largest unions.

San Francisco Superior Court Judge Curtis Karnow ordered the unions and BART not to threaten or engage in a strike through midnight on Oct. 10. BART and the two unions are expected to continue negotiations while the injunction is in place.

The strike, or even the threat of one, will "endanger the public's health safety or welfare," Karnow said in his order.

During an unusual Sunday morning court session before the order was issued, Karnow said the hearing had nothing to do with the merits of the contract dispute between BART and the unions. Attorneys for the two sides did not object to the injunction although union leaders had said earlier that Brown's request reduced the pressure to reach a deal.

The governor indicated he would seek a 60-day cooling-off period on Friday, as union leaders warned commuters that they were prepared to strike and shut down BART on Monday for the second time this summer if they didn't reach an agreement on a new contract over the weekend.

The unions went on strike last month, stopping BART service for four days. The shutdown snarled traffic on roadways and left commuters facing long lines for buses and ferries.

BART, the nation's fifth largest rail system, serves more than 400,000 commuters each weekday.

Sandy Zhou, 22, said her 40-minute commute on BART to work at a San Francisco Metro PCS store turned into a three-hour ordeal by bus during the strike. She applauded the reprieve.

"As long as it keeps the trains running, do whatever you have to do," she said. "I'm all for higher wages, but I need to get to work."

Negotiations between BART and Amalgamated Transit Union Local 1555 and Service Employees International Union Local 1021 began months ago, but the two sides remained tens of millions of dollars apart on wages, pensions and health care benefits last week.

BART said workers from the two unions now average about $71,000 in base salary and $11,000 in overtime annually. The workers pay nothing toward their pensions and pay a flat $92 monthly fee for health insurance.

The unions were set to go on strike again on Aug. 5 when Brown intervened and appointed a panel to investigate the labor dispute. He issued the request for the cooling-off period after the panel concluded a strike would significantly harm public welfare.

Dead shark is found in NYC subway car, disposed of

(AP) ? Did a fan of "Shark Week" get carried away?

New York City's transit authority says a conductor found a small dead shark aboard a subway train in Queens on Wednesday.

The conductor asked passengers to leave the car and closed it off. The train continued to the end of the line, and then a supervisor placed the shark in a garbage bag and put it in the trash.

Photos on the blog Gothamist depict the shark on the subway. It appears to be about 4 feet long, has a cigarette in its mouth with a fare card and Red Bull can nearby.

Transit officials say they were aware of the photos but are making no effort to find the person who posted them. The transit authority says it has "better things to do."

ITC rules Samsung infringed upon two Apple patents

The International Trade Commission returned with a ruling on Friday that could once again shift the dynamics of the domestic mobile market.

See also: Google expands open patent pledge to 79 more about data center management

The ITC sided with Apple this time, finding that Samsung infringed upon at least two of the iPhone maker's patents.

In other words, certain Samsung mobile devices could be banned from being sold in the United States soon.

The two patents in question are:

  • U.S. Patent No. 7,479,949 (a.k.a. the ?949 patent; affects claims 1, 4-6, 10, and 17-20): Concerns touch commands on touch-screen devices
  • U.S. Patent No. 7,912,501 (a.k.a. the ?501 patent; affects claims 1-4 and 8): Concerns input and output detection for microphone and headphone jacks

Here's a snippet from the ruling about the ITC's recommendation going forward:

The Commission has determined that the appropriate remedy is a limited exclusion order prohibiting Samsung from importing certain electronic digital media devices that infringe one or more of claims 1, 4-6, 10, and 17-20 of the ?949 patent and claims 1-4 and 8 of the ?501 patent. The Commission has also determined to issue cease and desist orders prohibiting SEA and STA from further importing, selling, and distributing articles that infringe one or more of claims 1, 4-6, 10, and 17-20 of the ?949 patent and claims 1-4 and 8 of the ?501 patent in the United States. The orders do not apply to the adjudicated design around products found not to infringe the asserted claims of the ?949 and the ?501 patents as identified in the final ID. The Commission has carefully considered the submissions of the parties and the public and has determined that the public interest factors enumerated in section 337(d)(1) and (f)(1) do not preclude issuance of the limited exclusion order and cease and desist orders.

It should be noted that the ITC found no infringement on the following four patents: Patent Nos. D618,678 (?the D?678 patent?); D558,757 (?the D?757 patent?); RE 41,922 (?the ?922 patent?); and 7,789,697 (?the ?697 patent?)..

Wrapping up an investigation stemming back from August 2011, the Commission declared that the decision is final and the investigation into the case is over.

The only way that Samsung could stave off a ban is if the decision is vetoed by President Obama.

Yet just last week, the White House shot down an ITC court ruling that would have prevented Apple from selling older versions of its iPhone and iPad in the United States.

The Presidential Review Period is the next 60 days, at which point the import ban will begin if the ITC's decision has not been overturned.

Plateau Baseball Club wins tournament opener

The Plateau Baseball Club, consisting of players from White River and Enumclaw high schools, opened play Saturday in the state American Legion championships.

The local squad opened with a 5-3 victory over Lakeside Recovery, then fell 18-11 Sunday to Mount Spokane. Sunday?s loss was particularly painful because the Plateau crew was ahead 8-0 after three innings; that was before the eastern Washiington team began pounding the baseball.

Monday afternoon, the Plateau club played a loser-out contest against Colville. A victory would assure the PBC of a top-eight finish.

Zachary Quinto plays Spock in the new "Star Trek" films, and may be making an appearance on "Big Bang Theory."

If Zachary Quinto appeared on "The Big Bang Theory," our whole universe would be in a hot dense state.?

"I met one of the producers at an event and we talked about the show," the actor, who plays "Star Trek's" Spock in the rebooted movie franchise, confirmed to TODAY.com. "I would love to do it if I could."?

And "Big Bang" would love to have him. Executive producer Steven Molaro told TODAY.com, "We think that's great. There's nothing set in stone yet, but if we can get that to work out we'd be really excited about it."?

If they do manage to make it so, Quinto would prefer not to follow in the Vulcan footsteps of Leonard Nimoy, who voiced a Spock action figure in the 2012 episode "The Transporter Malfunction."?

"I'll reserve another portrayal of Spock for the third 'Star Trek,' " Quinto told us.?

MOSCOW (AP) ? The American rock group Bloodhound Gang was kicked out of a Russian music festival and pelted with eggs after videos emerged of its bass player shoving a Russian flag down his pants at a recent concert in Ukraine. Russian prosecutors are even considering whether to open a criminal case in the matter, which comes amid a rise in U.S.-Russian tensions.

Videos posted online of Wednesday's concert in the Ukrainian city of Odessa show bass player Jared Hasselhoff pushing the Russian white, blue and red flag down the front of his pants and pulling it out the back. He then shouted to the audience: "Don't tell Putin," a reference to Russian President Vladimir Putin.

The incident outraged the Russian government. Maria Minina, a spokeswoman for the weeklong Kubana festival in southern Russia, said Saturday that the band's headlining performance the previous evening had been canceled because of its treatment of the flag.

The American band is known for its sexually explicit songs, including "The Bad Touch," with its unforgettable lyrics: "You and me, baby, ain't nothin' but mammals, so let's do it like they do on the Discovery Channel."

Russian Culture Minister Vladimir Medinsky tweeted Friday night that he had spoken with officials in the southern Krasnodar region, known as Kuban. "Bloodhound Gang is packing its bags," he said in the Twitter post. "These idiots will not perform in Kuban."

Hasselhoff was questioned Saturday by police, according to the Russian Interior Ministry, which said prosecutors have been asked to decide if the musician could be charged with defaming the Russian flag.

The bass player apologized late Friday at a news conference held at the music festival in the city of Anapa, the local Yuga.ru news portal reported. He was quoted saying that he had meant no offense and explaining that it was a band tradition for everything thrown from the stage first to be passed through his pants. Hasselhoff said he decided to throw the flag because some fans had seemed disturbed to see it hanging on the stage.

The scandal caused by the American band in Russia comes at a time of heightened tensions between the two countries over National Security Agency leaker Edward Snowden, who was given temporary asylum in Russia last week to help him evade prosecution in the U.S.

As the Bloodhound Gang members were driving to the Anapa airport on Saturday, activists from a pro-Kremlin youth group threw eggs and tomatoes at their vehicle, Yuga.ru reported.

The band members were taken off their afternoon flight to Moscow after they had already boarded the plane, Russian news agencies reported, citing airline officials. After being questioned by transport police, they took a later flight, the reports said.

GLOBAL MARKETS-U.S. stocks edge higher; bond yields, dollar slip on jobs data

NEW YORK, Aug 2 (Reuters) - Slower-than-expected U.S. jobs growth pushed Treasury yields and the dollar lower while stocks turned upward in late trading on Friday as investors grew cautious on the outlook for U.S. economic growth and Federal Reserve plans for trimming stimulus. The number of jobs outside the farming sector increased by 162,000 in July, although the unemployment rate fell to 7.4 percent, its lowest in over four years. The result was below the median forecast in a Reuters poll for 184,000 new jobs.

"Nothing in the jobs report says the economy is standing on its own. It was a confusing jobs report and it pushes tapering a little bit deeper into the fourth quarter," said Ron Florance, deputy chief investment officer at Wells Fargo Private Bank in Scottsdale, Arizona, in reference to expectations of the Fed's stimulus wind-down. Global markets suffered wild swings in May when the Fed indicated it might wind down easy monetary conditions. The Fed risks panicking markets again if it withdraws stimulus before the U.S. economic recovery is well established, the IMF warned in a report. After languishing for most of the New York session on the disappointing jobs number, U.S. benchmark indexes closed up as stock investors considered the Fed may leave stimulus in place a little longer than anticipated. The Dow Jones industrial average unofficially ended up 30.34 points, or 0.19 percent, at 15,658.36. The Standard & Poor's 500 Index was up 2.80 points, or 0.16 percent, at 1,709.67. The Nasdaq Composite Index was up 13.84 points, or 0.38 percent, at 3,689.59. European shares erased gains after the U.S. data but then recovered some of the drop, with the FTSEurofirst 300 closing up 0.3 percent. Earlier, the index touched a two-month high on a rally in insurers after earnings reports from AXA and Allianz. The MSCI world equity index was last up 0.5 percent. The benchmark 10-year U.S. Treasury note, which was in negative territory before the jobs report, gained 28/32 of a point, its yield easing to 2.6017 percent. DOLLAR FALLS The dollar fell against the euro and yen. It was last at 98.83 yen, down 0.7 percent, and $1.3282 against the euro, a gain of 0.6 percent for the common currency. "The report takes away more than it offers in the sense that it means that the decision to taper QE3 in September has become that much more difficult for the Federal Reserve," said Christopher Vecchio, currency analyst at DailyFX in New York. "As we learned after this Wednesday's FOMC policy meeting, the Fed isn't exactly excited about where the U.S. economy is right now." Spot gold fell as much as 1.9 percent to $1,282.69 an ounce ahead of the data but was last down 0.1 percent at $1,308.29. U.S. crude oil futures fell 1 percent to $106.79 a barrel but were still heading for 1.9 percent rise on the week. Brent crude oil reached a four-month peak of $110.09 a barrel and a weekly increase of 1.5 percent after two weeks of losses as the improving economic outlook for the world's biggest consumer added to concern over supply disruptions in Iraq, Libya and Nigeria.

US factory means buyers can customize Google phone

NEW YORK (AP) ? With its first smartphone designed completely in-house, Google is demonstrating one of the benefits of moving production from Asia to the U.S.: It's letting buyers customize phones to give them their own style.

Workers at the factory in Fort Worth, Texas, assemble the custom phone and Google ship it to the buyer's door within four days.

The Moto X is going on sale in about a month at all four national wireless carriers ? Verizon, AT&T, Sprint and T-Mobile ? starting at $200.

Initially, only AT&T will offer the customization option, but Google said it hopes to make it available across all carriers soon. The company will offer 18 different back covers ranging in color from "spearmint" to "cabernet," a choice of black or white fronts and seven different metallic accents for details like the volume button. That makes for 252 possible style variations of the phone.

The Moto X is the first smartphone to be assembled in the U.S. Even though the concept of the smartphone was pioneered here and many phones have been designed in the U.S., the vast majority of phones are assembled in Asia.

With labor costs rising in China, some electronics manufacturers are looking to move manufacturing back to the U.S. Apple is moving production of its Mac Pro desktop computers to the U.S. this year.

The Fort Worth factory will let Google stamp the phone as "Made in the U.S.," but assembly is just the last step in the manufacturing process, and accounts for relatively little of the cost of a smartphone. The cost largely lies in the chips, battery and display, most of which come from Asian factories. For instance, research firm iSuppli estimates that the components of Samsung's latest flagship phone, the Galaxy S4, cost $229, while the assembly costs $8.

Google sees other value in a U.S. factory.

"Over time, by having the engineers closer to the factory floor, we'll be able to innovate faster and develop products that actually are quite interesting down the road," said Dennis Woodside, head of Google's Motorola division.

The factory is owned and run by Flextronics International Ltd., a Singapore-based contract electronics manufacturer. It's set to employ 2,000 people.

Google bought cellphone pioneer Motorola Mobility for $12.4 billion last year. While it launched some phones last year after the acquisition, those were designed while Motorola was still independent. The Moto X is the first phone that "gives you some indication of how Google is thinking of hardware," Woodside said in an interview.

Google has previously worked with other phone manufacturers to create Google-branded "Nexus" phones as launch platforms for new versions of Android.

The Moto X looks much like other smartphones, with a 4.7-inch touch screen. It comes with a no-frills implementation of Google's Android operating system, a contrast to recent phones from Samsung and HTC, which put their own stamp on the software with various add-ons.

The most unusual feature of the Moto X, apart from the customization option, is that it's always listening for its owner's voice. When it hears the phrase, "Ok, Google Now..." followed by a command like "call Bob," it will wake up from standby and execute the command ?provided it understands it. Most smartphones offer voice control, but it's usually activated by pressing a button.

Rick Osterloh, the head of product management at Motorola, said the Moto X has a special chip devoted to listening, which means it doesn't have the drain the battery by keeping the main processor running all the time. It should be able to pick up the owner's voice even in the noise of a car, he said.

Google is backing the launch with a big marketing campaign, including TV ads. The Moto X represents its best chance this year to make back some of the money it spent on buying Motorola, and the $1.7 billion the division has accumulated in operating losses since the acquisition.

Motorola has become marginalized in the global smartphone market, taking just 1 percent of recent sales, according to research firm IDC. Google has slashed Motorola's workforce to 4,600 people, down from 20,300 last year.

The acquisition was motivated mainly by Google's desire to own Motorola's patent portfolio, which provides it with ammunition to defend fellow makers of Android phones from Apple's and Microsoft's patent claims. Motorola's patents haven't proved very useful so far, and the division puts Google in the uncomfortable position of competing with other companies that make Android phones.

Analysts see another value in Motorola: it gives Google a toehold in smartphones, acting as insurance against the possibility that Samsung, the dominant maker of Android phones, could jump ship to another operating system or create its own version of Android.

Google's stock rose $16.47, nearly 2 percent, to $904.22 Thursday.

Guocool: Chinese Fruit E-Commerce Looks Pretty Damn Tasty

guocool-logoHave you ever looked at the internet and thought ?I wish I could buy more sliced fruit on this?? If you have, then I have just startup for you. China?s Guocool is an e-commerce startup that?s focused on selling sliced fruit packages online. Seriously.

Needless to say, a business like this lives and dies by the quality of its food, and since I haven?t had a chance to actually taste the goods, I can?t really comment on the company?s potential longevity. But although it might sound crazy, a fruit-focused e-commerce website is actually a pretty clever idea. Many Chinese businesses offer fresh fruit to guests, lay out fruit platters for important meetings, or even provide free fruit to their employees. When I worked at Youku, for example, everyone got a piece of food for free every day. That food has to come from somewhere, and Guocool makes purchasing it online easy and attractive.

When I say attractive, I mean that in the aesthetic sense. The fruit on this website looks gorgeous. There?s no way it will look quite so good when it actually shows up at your door, but even so it?s hard to resist placing an order; I had just finished dinner when I started looking at the site and it made me hungry again. The company?s prices are significantly higher than what it would cost to just buy fruit at your local fruit stand and chop it up yourself, of course, but the website looks so damn good that I think a lot of people will be tempted to order online anyway.

It?s also worth pointing out that at least in major cities, delivery tends to be very fast, so the idea of buying fruit online is probably more appealing to Chinese urban denizens than it would be too many Westerners. Guocool may be a great option for many businesses looking for fruit, but I suspect that the company won?t only have corporate clients.

For once, my enthusiasm seems to be matched by others who?ve taken a look at the startup. Guocool is one of the hottest companies on 17startup, a database of Chinese tech startups, and right now its entry is full of comments about how the company looks promising. And indeed, it seems to be doing well. Guocool got a cash injection last fall to the tune of 1.2 million RMB ($196,000) from an angel investor, and the site now has a much sharper look and seems to be making great progress.

I reached out to the guys behind Guocool a few days ago to learn more about the startup, but thus far I haven?t heard back ? presumably they?re too busy chopping and shipping fruit. In any event, this is definitely one Chinese startup to keep an eye on, and if you?re in a Chinese city you might even consider sampling some of those delicious-looking blueberries.
