Church in Pussy Riot clemency call



The Russian Orthodox Church is asking for clemency for three jailed members of the rock band Pussy Riot if they repent for their ?punk prayer? for deliverance from president Vladimir Putin at Moscow?s main cathedral.

Today?s church statement comes a day before the women?s first appeal since they were convicted on hooliganism charges and sentenced to two years last month.

The church said that if the women make statements showing ?penitence and reconsideration of their action?, they ?shouldn?t be left unnoticed?.

Earlier this month, Russian prime minister Dmitry Medvedev said that keeping them in prison any longer would be ?unproductive? ? a statement that encouraged hopes the appeals court could set them free.

But sceptics pointed at the Kremlin?s ongoing crackdown on dissent, saying that their release would be unlikely.

Immigration Equality Praises Obama Administration for New, Written Guidance Providing Discretionary Relief to Lesbian & Gay Immigrant Families

Extension of Prosecutorial Discretion Follows Calls for Relief from Congressional Leaders

Washington, DC ?Immigration Equality today praised the Obama Administration, and specifically the Department of Homeland Security (DHS), for new, written guidance that will extend discretionary relief to lesbian, gay, bisexual and transgender (LGBT) immigrants with U.S. citizen spouses and partners. The new written directive, which was announced in response to a Congressional letter spearheaded by Minority Leader Nancy Pelosi (D-CA) and Congressman Jerrold Nadler (D-NY), marks one of the very first times LGBT families have been recognized within federal immigration policies. The guidelines, which are expected to be distributed soon to field offices across the country, will instruct officers and field agents to recognize LGBT families for purposes of relief as defined by a June 2011 memo from Immigration and Customs Enforcement Director John Morton.

?This is a huge step forward,? said Rachel B. Tiven, executive director of Immigration Equality. ?Until now, LGBT families and their lawyers had nothing to rely on but an oral promise that prosecutorial discretion would include all families. Today, DHS has responded to Congress and made that promise real. The Administration?s written guidance will help families facing separation and the field officers who are reviewing their cases.?

In the June 2011 memo from Director Morton, the Department of Homeland Security spelled out factors ICE officers should consider when deciding which immigration cases are classified as ?low priority? for removal. Those guidelines included family ties to a U.S. citizen. DHS stated verbally in August of last year that it intended for the ?family? guidelines to be LGBT-inclusive, but it had not previously distributed written guidance codifying that intent to field offices.? In a letter yesterday to the 84 Members of Congress who demanded written guidelines, the Administration said it intends to do so.

?In an effort to make clear the definition of the phrase ?family relationships,? I have directed ICE to disseminate written guidance to the field that the interpretation of the phrase ?family relationships? includes long-term, same-sex partners,? Homeland Security Secretary Janet Napolitano wrote.

?The new guidelines will put in writing a commitment the Administration has expressed over the past year,? said Tiven. ?Now, the courts and Congress should act to make relief permanent, and provide access to green cards for all LGBT families.?

Credit Unions Still Offer Free Checking And More

Although most big banks are pulling the plug on free products and services, credit unions throughout the country continue to offer many for free. See what you are missing if you haven?t joined yet.

Getting Free Checking Accounts

Kiss free checking goodbye if you still bank with one of the big giants. Bankrate.com says that the average service charge on non-interest bearing checking accounts is at an all time high of $5.48--up 25% from the previous year. Only 39% of the banks Bankrate.com polled now offer non-interest bearing free checking.

Also the days of keeping the bare minimum in your account are over at big banks--now the average minimum balance to avoid the fee has increased to $723, up 23%.

Although free checking appears to be almost non-existent at big banks, Bankrate.com surveyed 50 of the nation?s credit unions and found at least 72% still offer free checking with no required minimum balance.

Free checking, along with a smattering of other free products and services is what sets credit unions apart from fee happy big banks, says Carrie O?Connor, SVP/Lending Services at CommunityAmerica Credit Union ($1.5 billion, Lenexa, KS). ?As a dedicated advocate of financial education, CommunityAmerica is proud to offer our members financial coaching and credit counseling, free of charge,? she says.

?Our members currently also enjoy free checking accounts, as well as free online banking, free online bill pay, free mobile banking, free teller services and free shared branching services. It?s also worth noting our credit cards don?t have an annual fee and we have lower balance requirements to open CD?s ($500 minimum) and Money Markets ($1,000 minimum) than most banks.?

For members at SACU ($2.9 billion, San Antonio, TX), the choice is easy. ?The average checking monthly fee is $7 to $10 monthly (fees can be higher depending on bank),? explains Paige Ramsey-Palmer, APR, Corporate Communications Officer. ?The NSF fees are typically higher at banks compared to $25 courtesy pay/NSF fee. Typically, banks charge a fee if you don't maintain a minimum balance (normally higher than CU). However, SACU offers several free deposit products that don't require a minimum balance.?

Ramsey-Palmer says for those who choose the credit union?s popular, myGeneration Checking, members can earn a higher dividend rate on balances up to $25,000 if they meet certain criteria. ?The dividend rate is significantly higher than regular savings and somewhat higher than our money market account rate, so this could present not only a savings but also an earnings benefit to an account holder.?

Avoiding ATM Fees

Bankrate.com also reported that the average ATM surcharge increased by 4%--the eighth consecutive year of increases. Now, 100% of banks in the Bankrate.com survey said that they charge non-customers to use their ATM and many banks charge their own customers if they use another financial institution?s ATM. For customers paying fees on both ends, this could equate to an average of $4.07--just to use an ATM (up 7% from last year).

Credit union members are typically not charged a fee for using an outside ATM (by their own credit union) and members have free access to thousands of shared service centers worldwide. Additionally, many credit unions do not charge a fee when the member selects the ?cash back? option at point of sale. Of course every credit union is different so it?s important that members inquire about their credit union?s specific ATM program.

Accessing Online Services

Big banks are trying to get the average consumer to think that he or she doesn?t have access to the same type of technology at a credit union.

Not true says Martindale. "There are credit unions that have apps for mobile banking, so you can't just assume that only the big banks have the convenience factor," she says.

Providing a good plan to clients requires the correct balance of listening to what they are saying, hearing what they are not saying, and understanding what they should be talking about.? That is to say, counseling a client who owns a farm or ranch means respecting each client as a unique planning opportunity while keeping in mind the planning concerns that are generally applicable to farmers and ranchers.

Counseling the Client

Goal setting can be the most complicated part of the planning process, and if this step is not completed comprehensively, then all the legal techniques in the world are not going to allow the plan to execute properly because the plan is not oing to fit the client.? You need to know what it is that you as the attorney are being asked to ?solve.?

On the most basic level, the counselor role is defined by the professional rules of conduct that apply to attorneys.? These may differ in minor ways from state to state, but the general premises are universally applicable. (In Wisconsin, these rules are found in Wisconsin Supreme Court Rules Chapter 20: Rules of Professional Conduct for Attorneys.)? The first question is, who is your client?? The ansewr to this question is essential to practicing within the applicable ethical requirements.? ?The client? is whose interests you are representing, and the person whose voice should be carrying the most weight throughout the planning process.? the client is to whom you owe the duties of confidentiality and due diligence.? (WIS. SUP. CT R. 20:1.3-1.4)? This is the person with whom you should be entering into the representation agreement/engagement agreement/fee agreement. (WIS. SUP. CT R. 20:1.5)

Determining the identity of your client is relatively straightforward when handling a criminal matter, or a personal injury lawsuit, or even a single person estate plan.? However, this can be substantially more complicated when working with owners of farms and ranches.? these are often family businesses with a lot of people who have a lot of interests.? The person whose interests you are representing may not be the same person who has expressed a willingness to pay for your services or the same person who has offered to be a key contact person for phone calls and emails.? Failing to recognize that the decisions of one family member cannot be taken for granted as the decisions of the client could mean violating rules that pertain to conflicts of interes. (WIS. SUP. CT R. 20:1.7-1.8? Violating conflict of interest urles can then lead to formal reprimands, the forfeiture of fees, and/or removal from the representation of either or both clients. For a recent example of this in Wisconsin, see In re the estate of Rebecca Derzon v. Johnson. 2011AP377)

It is beneficial to include other family members in the planning process in addition to the client.? Succession planning requires key individuals who are part of that plan understand the plan, and also requires an attorney understanding of how much heirs are capable and willing to contribute in terms of financial contributions and effort.? heirs may be able to identify the gradual decline of mom and/or dad?s physical and mental capabilities.? On the other hand, mom and day may know best which children are the most financially competent.? Furthermore, other individuals who are not directly part of the plan but have valuable information to contribute, such as accountants and financial planners, are alsouseful people to have at the table.? Inclduing everyone in the conversation may save a substantial amount of time in terms of making sure information is adequately disseminated to all key players in an accurate manner.? This may include keeping that initial referral source in discussions if he or she was the initial troubleshooter.

To make sure the interests of the client are kept at the forefront throughout the planning process, conflict waivers should be utilized and explained to make sure everyone knows who the clients are and what that means for everyone else before any planning takes place (see WIS. SUP. CT R. 20:1.7). If the client grants someone else permission to communicate or receive information on their behalf, channels of communication directly with the clients should still be maintained to ensure that the clients? interests are not lost when others are included in the process (see WIS. SUP. CT R. 20:1.4).? This may mean one meeting with everyone and another meeting just with the clients.? This means figuring out a way to separate a dominant client from a more passive client to make sure both of them are represented fully.? Different attorneys will have different strategies for addressing this issue, but no matter the method, the objective should be the same.

The goal setting part of the estate planning process requires attorneys to utilize the ?counselor? part of the profession.? Farmers and ranchers are generally emotionally invested in the business, rather than looking at their businesses from a detached investment perspective.? An attorney must be able to listen to clients and others and pick up subtle cues regarding family dynamics, as well as the willingness and ability to proceed with a particular course of action.? This means knowing when to ask the hard follow-up questions, or knowing when to question an unenthusiastic response.

Substantive Considerations

Attorneys provide value in terms of understanding the variety of legal techniques and the considerations that are required before proceeding with those techniques.? Clients have often fixated on one or two key concerns that have brought them to your office.? the legal techniques of which they have knowledge depends o n their sophistication with legal matters, but often is based on what their relatives/friends/neighbors have experienced.? Aside from identifying the client and opening those channels of communication with the client, goal setting requires making sure that you have touched ont he possible areas of concern before suggesting a particular course of action with the client.

The following are possible concerns that should be considered regardless of whether the client articulates them as goals:

  1. Providing for owners during their lifetimes.? Consider retirement plans, the cost of long-term care, planning for a surviving spouse, and maintaining a particular standard of living.
  2. Providing for heirs.? Is the point simply to make sure that all the heirs ?get something,? or is there a particular plan of distribution that would make the most sense?? Should all the heirs be included in this process?
  3. Keeping the business in the family.? If the farm/ranch should continue to be run by family members, which family members, and how are they going to make that work financially and interpersonally?
  4. Minimizing financial costs. Minimize taxes on income, gifts and the estate; measure attorney fees versus probate administration fees, protect against creditors.
  5. Ease of administration.? Can key players properly administer a corporate entity and execute installment sales, or will a more straightforward (if slightly less optimal) plan be more likely to be administered effectively?

Some preparation can be done ahead of this meeting through making sure the initial contact with the client is productive.? Providing the client with introductory materials to better understand what planning invovles amay help them be better prepared and have less apprehension going into the initial meeting.? Likewise, asking for information from potential clients ahead of time, such as information on their family, their business and their finances can help you know in general what items will likely need to be discussed at that meeting.? Asking for them to spell out their specific concerns can provide an understanding of what they are expecting out of the initial meeting and the planning proess as a whole.

(AP) ? Republicans lashed out at President Barack Obama and senior administration officials over their evolving description of the deadly Sept. 11 attack on the U.S. Consulate in Libya, a late campaign-season broadside challenging the veracity and leadership of an incumbent on the upswing.

Desperate to reverse the apparent trajectory of the White House race, Republicans sense a political opportunity in Obama's reluctance to utter the words "terrorist attack" as well as the varying explanations emerging from the administration about the assault in Benghazi that killed Ambassador Chris Stevens and three other Americans.

Talk of Watergate-style scandal, stonewalling and cover-up echoed in the GOP ranks on Thursday, from the head of the party to members of Congress to Mitt Romney's campaign staff. This full-throated criticism comes five days before the first debate between Obama and Romney, with Republicans determined to cast the president as dishonest and ineffectual on both foreign and domestic policy.

"Amid Middle East turmoil and six weeks before the election, President Obama refuses to have an honest conversation with the American people," Reince Priebus, chairman of the Republican Party, wrote in an article for the website Real Clear Politics. "The country deserves honesty, not obfuscation, from our president."

Republicans say the administration has been slow to call the assault a terrorist attack and has criticized its initial insistence that the attack was a spontaneous response to the crude anti-Islam video that touched off demonstrations across the Middle East.

Since then, it has become clear that the Benghazi assault was distinct from the mobs that burned American flags and protested what they considered the blasphemy in the movie, but didn't attack U.S. personnel. Republicans have also suggested that the administration had intelligence suggesting the deadly attack might happen and ignored it.

"I think it's pretty clear that they haven't wanted to level with the American people. We expect candor from the president and transparency," Romney told Fox News this week.

The White House and Democrats accused the GOP of politicizing national security, with officials specifically mentioning Romney's quick swipe at Obama as an extremist sympathizer as the crisis was still unfolding in North Africa around Sept. 11.

"The Republican approach is to shoot first and ask questions later," Rep. Adam Smith of Washington state, the top Democrat on the House Armed Services Committee, said in an interview. "The administration wants to do an investigation and be as accurate as possible. That's the difference between partisan politics and trying to govern."

Democrats also used the criticism to recall the former Massachusetts governor's missteps during his summertime overseas trip and his omission in his prime-time speech at the Republican National Convention of any mention of U.S. military forces fighting in Afghanistan.

"Every time Mitt Romney has attempted to dip his toe into foreign policy quarters, it's been an unmitigated disaster," Obama campaign press secretary Jen Psaki said aboard Air Force One.

National security has provided few political openings for Romney and the GOP as Obama has shed the Democrats' past reputation for weakness by ordering the successful raid that killed terrorist leader Osama bin Laden and undercut al-Qaida. An Associated Press-GfK poll earlier this month found Obama with an edge over Romney on who Americans think can do a better job of protecting the country, 51 percent to 40 percent.

The economy and jobs are the dominant issues in the election, with few voters likely to cast their ballots based on events in Libya or conflicts overseas. Underscoring the general weariness after more than 10 years of war, some of the fiercest GOP defense hawks in Congress have suggested the United States withdraw its forces from Afghanistan, an even bolder step than Obama.

But the administration has struggled to present a coherent description of the assault in Libya, prompting questions from Republicans and Democrats about whether the United States had prior intelligence, whether the attack was planned and whether security was sufficient.

In that same AP poll, Americans approved of Obama's handling of Libya by just 45-41 percent. The poll was conducted within days of the assault.

Defense Secretary Leon Panetta on Thursday called it a terrorist attack.

"What terrorists were involved I think still remains to be determined by the investigation," he told reporters at the Pentagon. "But it clearly was a group of terrorists who conducted that attack."

Secretary of State Hillary Rodham Clinton and White House press secretary Jay Carney called the violence a terrorist attack last week. But Obama has declined several chances to call the incident a terrorist attack. He said last week that extremists used an anti-Islam video as an excuse to assault U.S. interests.

And just five days after the attack, U.S. Ambassador to the United Nations Susan Rice said the attack was a spontaneous reaction to the video. Her assessment was at odds with Libya's interim President Mohammed el-Megarif, who said there was no doubt the perpetrators had predetermined the date of the assault. Panetta said Thursday it was a "planned attack."

The FBI is investigating, but the apparent contradictions have prompted demands for information from Congress and a flurry of scathing letters to the administration.

So far, U.S. intelligence has indicated that heavily armed extremists numbering 50 or more attacked the consulate, relying on gun trucks for added firepower. They established a perimeter, limiting access to the compound. A first wave of attacks forced the Americans to flee to a fallback building, where a second group of extremists attacked with mortar fire. Stevens died of apparent smoke inhalation when he was caught inside one of the consulate buildings, which had been set on fire.

Officials have not singled out one responsible group, but have focused their attention on Ansar al-Shariah, a Libyan militant group led by a former detainee at the U.S. military-run prison in Guantanamo Bay, Cuba.

Gen. Martin Dempsey, chairman of the Joint Chiefs of Staff, said Thursday that there has been a "thread of intelligence reporting" about groups in eastern Libya trying to coalesce, but no specific threat to the consulate.

Since the fall of Libyan leader Moammar Gadhafi last year, militias, weapons and terrorists are common in Libya.

"It was just unbelievable that Ambassador Rice and Secretary Clinton and the White House spokesman and others would say that there was no evidence ? that this was a spontaneous attack, yet they say, 'come on, honey, bring your mortars, we're going to a spontaneous demonstration,'" Sen. John McCain, R-Ariz., said on CBS' "This Morning."

McCain, who called the administration's statements "disgraceful," joined three other Republican senators this week in a letter to Rice pressing her on her "troubling statements that are inconsistent with the facts."

Eight Republicans who head House committees sent a letter to Obama criticizing a "pre-9/11 mindset" of "treating an act of war solely as a criminal matter." They said they would return to Washington from their nearly two-month recess for briefings beyond the back-to-back sessions Clinton and others held last week.

Sens. Bob Corker, R-Tenn., and Johnny Isakson, R-Ga., have asked for communications between the State Department and the U.S. mission in Libya leading up to the attacks.

Senate Foreign Relations Committee Chairman John Kerry, D-Mass., has written the State Department's Thomas Nides asking him to provide the panel with a detailed accounting of the attacks on U.S. missions in Libya, Egypt and Yemen on Sept. 11, information on security and whether there was any prior intelligence.

Sen. Chris Coons, D-Del., a member of the panel, said the purpose of this letter is a bipartisan effort to get information.

"I do think it is legitimate and appropriate to ask questions," Coons said in an interview. "Some have sadly overreached and clearly are politicizing this incident."

Aerobics workout does not burn cholesterol the way we know it burns fat, but what it does is stimulate the blood?s cholesterol levels and lower LDL (bad) cholesterol, triglycerides and increase HDL (good) cholesterol.

Harby Panesar's company went bust after he lavished a fortune on daughter, Anysha, who is now 19, so she could live her teenage dreams.

The court was told that he is now 'far removed from his once luxurious life' - and is 'financially ruined and bankrupt.'

Lord Rix said: "The public interest will be sufficiently vindicated by suspending the term."

Panesar made his money through his insurance company Motorcare Warranties which has collapsed.

An investigation by the Financial Services Authority found that the company left a trail of victims whose motor insurance policies were worthless.

A bankruptcy hearing in the High Court banned Panesar from setting up a new business. But Panesar was found in contempt of court by launching up a new insurance company called Motorcare Warranties.

Panesar, 45, and his wife Caroline, 43, now face losing their luxury ?500,000 home and their six-acre estate in the Vale of Glamorgan.
