Alleged kidnapper: I 'didn't mean' to kill baby, grandma

PHILADELPHIA --?The man charged in the murder of a baby and her grandmother during a botched kidnapping and ransom scheme?claimed that he killed both victims by accident, according to video released during his court appearance Wednesday.

Raghunandan Yandamuri, 26, is accused of murdering 10-month-old Saanvi Venna and her grandmother, Satyavathi Venna, 61, last month. It happened on Oct. 22, at an apartment complex in Upper Merion where both the Venna family and Yandamuri, a family friend, lived.

Police believe Yandamuri went to the apartment with the intention of kidnapping Saanvi and holding her for ransom. But police say Satyavathi, who was babysitting the child, fought for her granddaughter and was fatally stabbed by Yandamuri.

On Oct. 26, the baby's body was found in the basement of the apartment building and Yandamuri was arrested. Police say they also found a ransom note from Yandamuri demanding $50,000.

'Didn't mean to kill anyone'
On Wednesday, Yandamuri appeared in court for a preliminary hearing. During the hearing, a 23-minute video confession was played for the court, according to NBC10's Deanna Durante.

In the video, Yandamuri told police he "accidentally" slit Satyavathi Venna's throat and that he "didn't mean to kill anyone." The video also showed him confessing to stuffing a handkerchief in the baby's mouth and wrapping a towel around her head when she wouldn't stop crying.

Yandamuri said in the video that he put the baby in a suitcase, escaped via a fire escape and sneaked into the basement of another apartment building.

Yandamuri also told police that when he took Saanvi out of the suitcase the towel was still wrapped around her face and she was unconscious. He said he removed the towel and handkerchief, splashed water on her and left her in the basement while he returned home, took a shower and went to work.

He also told police he went back to the basement around 3:30 p.m. with a bottle of milk for the girl but that she was already dead.

Yandamuri's defense attorney argued in court that since his client did not mean to kill anyone, first-degree murder should be taken off the table. Prosecutors disagreed, citing Yandamuri's ransom note as evidence against the attorney's claim.

According to prosecutors, 10 copies of the ransom note were left in the apartment of the Venna family with several references that if they didn't bring $50,000 by 8 p.m. that night that the baby would be killed. Prosecutors say that showed there was intention and premeditation for murder. The judge agreed with the prosecutors and ordered that Yandamuri stand trial on charges of first-degree murder, kidnapping, robbery, theft and abuse of corpse. ??

If you're subscribed to BT's landline phone service, you may want to keep an eye on your bill in the near future. The British provider recently patched up a website issue that showed account holders' full names, but attention is being drawn to an approach that lets visitors add paid features like TV service using only an account's phone number and postcode as credentials. When both of these are potentially in the public eye, that creates understandable concerns that a rogue agent could hike someone's rates without consent -- even the email address BT uses to confirm changes is only chosen on the spot, which could keep the change a secret early on. BT so far contends that the light security is for "customer convenience," although we've reached out to verify whether or not that will continue to be the company's policy going forward. In the meantime, those still on the carrier's traditional phone service will want to be careful about giving out their number to strangers; while the risk isn't extreme in practice, there's no need to hand someone the keys to the kingdom.

BLOOMINGTON, Ind. (AP) ? No. 1 Indiana had something to prove Tuesday night ? that it could play defense.

Just two days after the Hoosiers put together their best game this season, they delivered an even more impressive performance, getting 20 points from Cody Zeller and 19 each from Will Sheehey and Victor Oladipo, running away from No. 14 North Carolina 83-59 in the ACC-Big Ten Challenge.

"Our guys played great basketball tonight," coach Tom Crean said. "We played against an incredible opponent, everybody understands how great North Carolina is. Our guys had an edge to them tonight, and it was on the defensive end as much as anything else."

The conventional wisdom is that the Hoosiers (7-0) are one of the nation's top scoring teams.

But the detractors have questioned Indiana's willingness to defend and some have even suggested that weakness has allowed No. 2 Duke to close the gap on the nation's top-ranked team.

North Carolina coach Roy Williams disagrees.

"I think they are," he said when asked whether Indiana deserved to be No. 1. "The thing I like about them is they really are a team. They don't have one guy that beats you up, they beat you so many different ways."

Williams and the Tar Heels (5-2) learned that lesson the hard way in Bloomington.

In the second half, the Tar Heels shot just 27.8 percent from the field and went 0 for 5 from 3-point range. They were outscored 12-8 on the fast break, an area that had caused so much concern for Crean that he lost sleep leading up to the game.

"I know people criticize us for our defense, and they say 'If they can't play defense, how good can they really be?'" Oladipo said.

Offensively, the Hoosiers were their usual balanced selves.

Zeller was 8 of 13 from the field with four blocks, one steal and an assist. Oladipo and Sheehey were both 8 of 12 from the field. Senior guard Jordan Hulls was 5 of 8, including three 3-pointers, and finished with 13 points, eight assists and two steals.

"It's cool," Oladipo said when asked about beating a program like North Carolina this handily. "I mean, we've been working really hard and you guys know as well as I know that this program, well not last year, but over the last couple of years was really struggling and we wanted to get it back to where it belongs, which is on top. So to get a win like that, it's a humbling experience."

The best thing about this game for North Carolina may be the end of its run against teams from the Hoosier State.

A week ago, North Carolina trailed by 29 points in the second half before falling 82-71 to two-time national runner-up Butler.

On Tuesday, it was almost an instant replay.

Indiana closed the first half fast, started the second half fast and spent the rest of the game pulling away. The Hoosiers' biggest lead, 83-51, came with 4:22 left in the game.

Dexter Strickland led the Tar Heels with 14 points, Marcus Paige had 11 and James Michael McAdoo had 10 points and nine rebounds for North Carolina, which was missing sophomore guard P.J. Hairston, who stayed home with a sprained left knee.

There was a bigger problem, though. North Carolina couldn't figure out how to contain Zeller, one of this season's favorites to be the national player of the year.

"Boy, I would love to watch them play if it wasn't against my team," Williams said. "You look down the lineup and Cody Zeller, he's family to begin with, he's really a load to handle, and two other guys that I didn't even hear of when they were in high school, they just kicked our rear ends."

The game pitting two of the country's most storied programs ? which have combined for 10 national titles and 3,767 wins ? had been billed as one of this season's showcase events. For 16 minutes, it lived up to the hype.

Zeller changed everything with two flurries.

By setting high picks and drawing post players outside, it opened up the lanes for his cutting and slashing teammates who wasted no time exploiting the holes in the Carolina defense, using a 15-6 run at the end of the first half to take a 46-37 halftime lead.

The Hoosiers were only getting started.

"If you let them dictate and control the pace of the game, they're going to win," Crean said. "So we had to control and dictate the pace of the game, and to do that, we had to run."

But in the second half, the Hoosiers were out to prove something else ? that they could defend.

Over the first 8? minutes, North Carolina managed only three points, the tip-in and a free throw.

Zeller and Oladipo, meanwhile, combined for seven points in the opening 13-0 blitz that put Indiana ahead 59-37, and North Carolina never challenged again as the Hoosiers won their 34th consecutive home game in November against a team that was supposed to cause havoc.

"It's a huge statement," Sheehey said. "We prepared for this game for a couple of weeks now and that's about it. You saw the score. We played hard, we played well, we played together and when we do that, stuff is going to happen."

Congo says no talks with rebels unless they quit Goma

GOMA, Democratic Republic of Congo (Reuters) - Congo said on Sunday it would not negotiate with M23 rebels in the east until they pulled out of the city of Goma, but a rebel spokesman said Kinshasa was in no position to set conditions on peace talks.

Congolese President Joseph Kabila met with M23 for the first time on Saturday after an urgent summit in Uganda where regional leaders gave M23 two days to leave Goma, which the rebels seized six days ago after U.N.-backed government troops melted away.

Eight months into a rebellion that U.N. experts say is backed by neighboring Rwanda, the rebels have so far shown no sign of quitting the lakeside city of one million people.

The rebels say they plan to march on other cities in the east, and then strike out across the country to the capital Kinshasa, across 1,000 miles of dense jungle with few roads, a daunting feat achieved 15 years ago by Kabila's father.

Amani Kabasha, a spokesman for M23's political arm, welcomed the meeting with Kabila but questioned the government's resolve to end a crisis that risks engulfing the region.

"Why put conditions on talks? You pose conditions when you are in a position of strength. Is the government really in such a position?" Kabasha told Reuters in Goma, which sits on the north shore of Lake Kivu at Congo's eastern border with Rwanda.

Vianney Kazarama, the rebels' military spokesman, said government forces that had been reinforcing along the shores of the lake were now deploying in hills around the rebel held town of Sake and government-held Minova, both Goma's west.

A U.N. source in Minova said government soldiers had gone on a looting spree for a second straight night there. The town was calm on Sunday but gunshots rang out overnight, the source said.

"What is real is that the morale of the troops is very low. They've lost hope in the commanders," the U.N. source said.

The Congolese army has vowed to launch counter-offensives and win back lost territory. The rebels have warned the government against embarking on a "new military adventure".

So far, the unruly and poorly-led army has been little match for the rebels, despite assistance from a U.N. peacekeeping mission that deployed attack helicopters to support the government before Goma fell.

Rebel leaders share ethnic ties with the Tutsi leadership of Rwanda, a small but militarily capable neighbor that intervened often in eastern Congo in the 18 years since Hutu perpetrators of Rwanda's genocide took shelter there. Rwanda has repeatedly denied Congolese and U.N. accusations it is behind M23.

Saturday's Kampala summit called on the rebels to abandon their aim of toppling the government and proposed that government troops be redeployed inside Goma.

The rebels have not explicitly rejected or accepted the proposals. They are, however, unlikely to cede control of the city or accept government soldiers inside it.

WITHDRAW

Regional and international leaders are trying to halt the latest bout of violence in eastern Congo, where millions have died of hunger and disease in nearly two decades of fighting fuelled by local and regional politics, ethnic rifts and competition for reserves of gold, tin and coltan.

"Negotiations will start after the (M23) withdrawal from Goma," Congolese government spokesman Lambert Mende said.

Kabila was still in the Ugandan capital on Sunday morning but was expected to return to Kinshasa later in the day or on Monday, two Congo government sources said. Kabila's communications chief Andre Ngwej said he did not believe official talks would start in the next few days.

While Kabila's army is on the back foot, analysts are skeptical the rebels can make good on their threat to march on Kinshasa without major support from foreign backers.

The regional leaders' plan proposed deploying a joint force at Goma airport comprising of a company of neutral African troops, a company of the Congolese army (FARDC) and a company of the M23.

In a statement, the Kinshasa government said Tanzania would take command of the neutral force and that South Africa had offered "substantial" logistical and financial contributions towards it. The Kampala plan did not say what the consequences would be if the rebels did not comply.

Kuwait to allow protest march on eve of election: PM

KUWAIT (Reuters) - Authorities will allow a protest march to go ahead the day before the December 1 parliamentary election in Kuwait, the Gulf Arab state's prime minister said in a move designed to ease tensions ahead of the poll.

Thousands of people have staged regular demonstrations since late October against a decree issued by Kuwait's ruler, Sheikh Sabah al-Ahmad al-Sabah, which reduced the number of votes allowed per citizen to one from four.

The opposition movement, which includes youth groups and former members of parliament, has called for a boycott of the election in the U.S.-allied major oil producer over the changes.

They say the amendments are an attempt to skew the elections in favor of pro-government candidates. Protesters say they seek reform, not an Arab Spring-style revolution like those that have ousted several Arab rulers since early last year.

The emir says the voting system is flawed and that the changes are constitutional and needed for the sake of Kuwait's "security and stability".

Prime Minister Sheikh Jaber al-Mubarak al-Sabah said "the organizers got a license from the concerned security services, so the government had nothing against the march," state news agency KUNA reported late on Monday.

Kuwait allows the most dissent among the Gulf Arab states and its citizens often hold rallies in a designated area outside parliament.

But recent unlicensed protest marches in the streets beyond have been broken up by police using teargas and smoke bombs.

Authorities are keen to prevent the kind of unrest Kuwait experienced on October 21, when thousands of demonstrators attempted to reach government headquarters in the largest protest march and were dispersed by police. At least 29 people were injured during that march, according to a medical source.

CORRUPTION, STALLED DEVELOPMENT

Under the new rules, each voter chooses only one candidate instead of four, a move the parliamentary opposition says will prevent its candidates winning the majority they had in the last election.

They say the four-vote system better enabled candidates to form political allegiances during the election campaign by recommending supporters cast additional ballots for their allies. Such allegiances are important because Kuwait bans political parties, opposition politicians say.

Apart from protesting against the new voting rules, activists have rallied against wider issues such as corruption, the accountability of government ministers and elected officials as well as a lack of infrastructure development.

A long-running row between the government and parliament has stalled implementation of major parts of a 30 billion dinar ($107 billion) development plan, including large infrastructure projects.

The December 1 poll will be the fifth since mid-2006.

"The coming government will include decision makers and bold politicians to scale up the combat against corruption," Sheikh Jaber said, according to KUNA.

"The coming stage will see a quantum leap in economic development and the stage set for implementing mega projects, some of which have already been approved," he said.

The 50-member parliament has legislative powers and the right to summon ministers for questioning. But the emir has the final say in state affairs and can veto laws and dissolve the assembly.

Opposition MPs - whose demands have included an elected cabinet including the prime minister, with at least some top posts held by people other than relatives of the emir - held some 35 seats in the 50-seat parliament elected in February 2012.

The opposition bloc put pressure on government ministers, leading to the resignation of two. The parliament was dissolved by a court ruling in June.

Sheikh Jaber said the last parliament "failed to encourage the government to adopt positive steps ... contrary to the spirit of the constitution which favors cooperation between the legislative and executive authorities," KUNA reported.

The United States government has collaborated with Guyana on a number of areas relating to customer service, such as the USAID programme, which is working to promote eco-tourism, particularly in fishing and birding.
Deputy Chief of Mission Thomas Pierce applauded the Georgetown Chamber of Commerce and Industry (GCCI) for initiating a recent session on customer service and its significance to economic growth.

Pierce noted that eco-tourism is a segment of the market for which quality services is vital to attract and retain customers and to grow the reputation of businesses to gain international visitors who will journey to Guyana.
The deputy chief of mission said that it does not take very many encounters when someone visits a place to form an overall impression about the entire country.? He cited that the example of someone visiting a foreign capital and having a positive experience with the taxi driver during the ride from the airport, or the friendly hotel clerk, would reflect on the entire population.
Conversely, it would not take very many experiences such as slow service, rude hotel staff, etc to cripple a country?s image.
USAID has also been involved in the Skills, Knowledge and Youth Em-ployment (SKYE) programme, which is a partnership with private businesses to train young people, particularly at-risk youths to become productive citizens.
Pierce pointed out that customer service is a crucial component of all businesses, and can be correlated to the broader development of a country. ?Customers also go where they are welcomed, but stay where they are well treated,? the U.S. representative stated.

Enabling environment
He mentioned too that although government is charged with providing an environment in which businesses can prosper; it is the courage of entrepreneurs and the dedication of management and staff to successfully run businesses that generate individual, national and global prosperity. ?It is much easier to keep a customer than to go out and find new customers. Investors will seek stable and predictable investment climates with transparency and rule of law,? Pierce said.
He remarked that investors also weigh factors such as infrastructural development, protection of intellectual property rights, compliance with financial norms, and the quality of the labour force.
Pierce said private sector organisations have a legitimate voice in the dialogue of these issues and the business community has a role in shaping society through activities in the marketplace.
They are also expected to promote policies as an example in exercising corporate social responsibility, and giving back to the community.
The local business community has been urged to step up to the plate in addressing issues relating to staff hostility and overall customer service.
Generally, customer service in Guyana has not been up to scratch, and more effort is needed to boost the hospitality industry in terms of customer relations. Recognising this need, GCCI held a customer relations seminar at the Guyana Pegasus Hotel with the intention of helping participants increase their customer service skills, develop a greater appreciation of customer value, and raise the quality of the service they provide to customers.
Economic and commercial officer at the U.S. embassy, Eric Moore, who delivered remarks, noted that customer service begins in advance of a business interacting with customers. BRUSSELS (AP) ? Finance ministers from the 17 European Union countries that use the euro are trying to hammer out a deal Monday in Brussels on the next installment of bailout money for struggling Greece.

On his way into the meeting, Olli Rehn, the EU's top financial official, said it was important for the ministers and the International Monetary Fund to agree on a deal. "I want to encourage all the euro area member states and the IMF to go the last mile to find an agreement ? in fact to go the last centimeter, because we are so close," Rehn said. "Greece has delivered. Now it is the delivery time for the eurogroup and the IMF."

The so-called troika of the European Central Bank, IMF and the European Commission, which is the 27-country EU's executive arm, have twice agreed to bail out Greece, pledging a total of ?240 billion in rescue loans. In return for its bailout loans, Greece has had to impose several rounds of austerity measures and submit its economy to scrutiny.

Greece's fortunes are inextricably tied to the rest of the eurozone. Without the bailout funds that have been keeping it afloat since May 2010, the country would default and could end up having to leave the eurozone. This could have a domino effect on other financially troubled eurozone nations.

Greek Finance Minister Yannis Stournaras said action needed to be taken.

"Greece has fully delivered its part to the agreement, so we expect our partners to deliver their part, too, and I am sure we will find a mutually beneficial solution," he said.

But the prospect of yet another batch of bailout money left some ordinary Greeks unimpressed.

"Did we get anything from any of the previous loan installments?" asked Eleni Myronidou, a retiree in Athens. "Did the people get anything? The banks did. It's all about the banks. Nothing for the people. They should be ashamed of themselves. They should be ashamed."

Greece is unlikely to complete its program of budget cuts and reforms by 2014. For this reason, it is likely to be given an additional two years by the troika. But that extension will cost several billion more, and it is disagreements over how to fund this that have stopped Greece from getting its money.

Several proposals have been floated as ways to plug the financial hole. These include reducing the interest rate Greece pays on its loans from euro partners, lenders such as the ECB giving up interest or profit on their loans, a debt buyback that would reduce the country's burden in the long term, and debt forgiveness by some other countries in the eurozone.

But most of those solutions involved dipping once again into the pockets of taxpayers ? something that has become increasingly unpalatable politically.

"There have been disputes in recent weeks among the members of the troika," said Craig Erlam, an analyst at Alpari. "However these are expected to be resolved today, meaning Greece will finally receive the next bailout payment. If not, Greece could run out of money in the coming days, the consequences of which could be disastrous for the eurozone."

The troika partners disagree on whether Greece should be given an extra two years, to 2022, to bring its debt down to 120 percent of gross domestic product from the 176 percent forecast for this year. The IMF has resisted such an extension.

The ministers hope to reach a political agreement Monday. That agreement will have to be submitted to national parliaments in some countries. After that, the finance ministers plan to hold another meeting, either in person or by telephone, to give final approval to the disbursement.

German Finance Minister Wolfgang Schaeuble ruled out a public-sector debt write-off, and said other eurozone member countries had taken the same position.

But he said he was optimistic about the talks.

"We will find a solution, I am very confident of that," Schaeuble said.

Argentina's options shrink after U.S. debt ruling

BUENOS AIRES (Reuters) - A decade after staging the biggest sovereign default in history, Argentina faces another possible debt crisis after a U.S. court ordered it to pay $1.3 billion to holders of defaulted bonds.

About 93 percent of Argentine bondholders agreed in 2005 and 2010 to swap defaulted debt from the 2002 default for new paper at a steep discount. So-called "holdout" creditors who rejected the swaps continue to battle for full repayment in international courts.

In a ruling late on Wednesday, U.S. District Judge Thomas Griesa told Argentina to deposit funds to pay the holdouts by December 15, lifting a previous order stalling payments to the bondholders and raising fears of a technical default on the restructured bonds if Argentina does not pay.

Griesa's ruling is a sharp blow for Argentina's combative president, Cristina Fernandez, who has refused to pay the holdouts such as Elliot Management Corp's NML Capital Ltd and Aurelius Capital Management.

Her government's strategy of isolating the holdouts has come under intense pressure since late last month when a U.S. appeals court upheld Griesa's decision that Argentina violated equal-treatment provisions for all creditors when it chose to pay exchange bondholders and not holdouts.

An eventual technical default - with U.S. courts seizing payments to holders of restructured bonds to compensate the holdouts - would further dent investor confidence in Latin America's third-biggest economy.

That could exacerbate a sharp economic slowdown, but the impact would be less serious than in 2002 due to the country's relative isolation from global financial markets.

Argentina has stayed out of international credit markets since the 2002 debacle, partly due to fears the holdouts could block a new issue. It relies instead on the central bank's foreign reserves to pay debt and borrows from state agencies.

Here are possible scenarios in the decade-long legal battle:

ARGENTINA CHALLENGES RULING IN APPEALS COURT

Griesa's latest decision must still pass to the 2nd Circuit Court of Appeals, so he ordered that Argentina should deposit the money in an escrow account by December 15 rather than pay the plaintiffs directly.

Argentina swiftly pledged to appeal. If Griesa's ruling holds -- which legal specialists think likely -- and Argentina still refuses to pay, U.S. courts could block debt payments to creditors who took part in the debt swaps out of consideration for those holdout investors who rejected Argentina's terms at the time.

That would trigger a technical default on approximately $24 billion worth of restructured debt. Argentine bond prices were battered on Friday by fears about $3 billion in debt payments due next month could be subject to court.

The decision by Griesa came in response to a request from the appeals court for him to detail how the holdout creditors should be paid and clarify the role of third parties.

Late last month, the appeals court backed a February ruling by Griesa that Argentina had discriminated against the holdouts and Argentina has already requested a rehearing before the tribunal's full panel of 13 judges.

However, legal analysts think the so-called en banc rehearing is unlikely to yield a different result and say the 2nd Circuit will probably refer Monday's planned appeal aimed at getting the payment stay reinstated back to Griesa.

ARGENTINA TURNS TO THE U.S. SUPREME COURT

Economy Minister Hernan Lorenzino said Argentina will exhaust all judicial channels and could take the holdouts case to the U.S. Supreme Court.

The government could contest the appeals court's equal treatment ruling by arguing it did not discriminate against the holdouts because they could have tendered their defaulted bonds in the two restructurings.

The U.S. Supreme Court gets about 10,000 appeals requests a year but only agrees to hear 75 or 80 cases.

Some legal experts think the country's highest court could choose to weigh in on this case, however, since it has wider implications for debt restructurings.

U.S. government lawyers backed Argentina's position on pari passu, or with equal treatment. They argued in April that Griesa's orders "could enable a single creditor to thwart the implementation of an internationally supported restructuring plan, and thereby undermine the decades of effort the United States has expended to encourage a system of cooperative resolution of sovereign debt crises".

If the Supreme Court agreed to take on the case, it would have to consider whether to freeze current proceedings. That might end up buying Argentina more time.

The government lawyers said a similar ruling in a Belgian court that disrupted Peru's debt restructuring in 2000 "was viewed with almost universal consternation by international financial markets".

The 2nd Circuit downplayed any impact on other countries, noting that many newer bonds, including the ones issued by Argentina in its 2005 and 2010 debt swaps, have collective action clauses that force potential holdouts to accept a restructuring if the vast majority of other creditors do so.

Argentina will probably need to garner more support from Washington and U.S.-based banks to get the Supreme Court to intervene. If the court did agree to hear the case, a ruling might not be issued until 2014.

If Argentina won the appeal, its troubles could be over. But the uncertainty leading up to the ruling would likely weigh on Argentine bond prices and hurt liquidity regardless.

Alternatively, the Supreme Court could either refuse to hear the case, letting the appeals court ruling stand, or it could hear the case and affirm that ruling. This would force Argentina to comply with - or openly violate - the order to pay holdouts every time it services its restructured debt.

ARGENTINA IGNORES COURT RULINGS

If Argentina loses its court battle at any point, the country could flout Griesa's payment orders to deposit funds for the holdouts.

This is seen as a real possibility since Argentina has systematically fought every court decision in favor of the holdouts and has refused to pay them court-awarded damages.

Argentine officials, including the economy minister and the president herself, have said the country will not negotiate with the "vulture funds" and will never pay them.

They say their responsibility to restructured bondholders ends when payment funds are deposited in a Buenos Aires account of the country's payment agency, Bank of New York Mellon. Argentina will make that transfer at all costs to avoid an outright default and reduce the political cost.

The government argues that when those funds are transferred to New York, they are already the property of creditors and therefore cannot be embargoed by U.S. courts.

Griesa, however, said all third parties involved in the payment of the bonds are responsible for ensuring his orders are fulfilled.

ARGENTINA PAYS HOLDOUTS

Although it seems unlikely, Argentina could end up paying the holdouts, either by making separate, proportional payments to them to comply with the court order or by agreeing to some kind of settlement. This could potentially prompt lawsuits by the creditors who accepted the swaps, however.

To pay the holdouts, it would first have to suspend or scrap the so-called "lock law", which requires prior congressional authorization for any kind of settlement with creditors who rejected the restructuring. The law also bars the government from reopening the debt swaps without legislative approval.

The government might want to change that law regardless since the appeals court cited it as key evidence that Argentina discriminates against the holdouts.

So far, officials have rejected that option, however.

Besides, the terms of the restructured bonds prevent Argentina from making better offers to creditors before December 31, 2014.

Even if the lock law were overhauled, this would not put an end to Argentina's legal woes since the holdouts would almost certainly refuse to agree to the swap terms and continue to sue for full repayment on their defaulted bonds.

Lawyers advising the holdouts say Argentina may be approaching a point of no return like the one Peru faced in 2000, when it ended up settling with the holdouts for $58 million to move forward with its debt restructuring.

The price tag for Argentina would be much higher, though, with holdout creditors owning a total of roughly $11 billion in defaulted debt, according to private estimates. That is equivalent to about a quarter of Argentina's foreign reserves.

Asian shares rise on hopes for U.S. fiscal deal

TOKYO (Reuters) - Asian shares rose on Tuesday on hopes of a compromise in the U.S. fiscal crisis, while the euro fell after Moody's Investors Service scrapped France's top-notch credit rating, reminding investors of the downside risk from the euro zone debt woes.

With risk assets from stocks to commodities rallying over the past two sessions, recovering some of last week's sharp losses, markets were prone to profit taking as trading will likely slow ahead of Thanksgiving holiday weekend.

The dollar steadied against a basket of key currencies <.dxy> after Monday's 0.5 percent drop, capping commodities and gold. Oil also retreated from a near 3 percent jump on Monday.

U.S. stock futures eased 0.1 percent to hint at a weak Wall Street open. Financial spreadbetters predict London's FTSE 100 <.ftse>, Paris's CAC-40 <.fchi> and Frankfurt's DAX <.gdaxi> will open down as much as 0.3 percent. <.l><.eu><.n/>

MSCI's broadest index of Asia-Pacific shares outside Japan <.miapj0000pus> added 0.7 percent, led by the materials and technology sectors <.miapjmt00pus><.miappjit00pus>.

Wall street climbed nearly 2 percent on Monday thanks to expectations that U.S. Congress reach a compromise to avoid $600 billion in tax increases and spending cuts due to start in January - the "fiscal cliff" that threatens to derail the U.S. economy.

"There's some optimism at the moment about the Americans doing something constructive about their fiscal cliff problem," said Damien Boey, equity strategist at Credit Suisse.

Tech stocks lifted Korean shares <.ks11> up 0.6 percent and Hong Kong <.hsi> stocks added 0.8 percent to a one-week high.

Shanghai shares <.ssec> fell 0.5 percent, nearing their lowest since early 2009 hit on Monday, after data showed China's foreign direct investment inflows fell 3.45 percent in the first 10 months of 2012 from a year ago.

Japan's Nikkei average <.n225> inched down 0.1 percent, after reaching a fresh two-month high earlier in the day. <.t/>

As expected, the Bank of Japan took no fresh steps after a two-day policy meeting on Tuesday, reiterating that it would pursue powerful monetary easing as Japan's economy is weakening.

The dollar fell 0.2 percent to 81.23 yen, but held near its highest since April 25 of 81.59 yen touched on Monday.

David Baran, co-founder of Tokyo-based hedge fund Symphony Financial Partners, said Japanese equities and the yen were attractive in comparison to other Asian assets. Nikkei has stayed at the lower end of ranges through 2012 and there are expectations that next month's election will result in a government that wants the BOJ to take stronger stimulus steps.

"Just from a risk-reward standpoint, you are seeing investors looking at Japan, looking at the yen and natural extrapolation of maybe we've seen the end of the bottom range of the dollar/yen," he said. "If you are trying to trade big moves, turning points, then you are getting into low risk, high reward possibility in yen and subsequently Japanese equities."

TAIL RISKS REMAIN

Euro zone finance ministers are expected to give a tentative go-ahead for the disbursement of 44 billion euros in emergency loans to Greece at a meeting later on Tuesday and discuss how to reduce Greek debt and provide two extra years of external financing to help Athens meet its fiscal target.

Ratings agency Fitch on Monday warned that failure to reach a deal on the "fiscal cliff" could trigger a recession and push the U.S. jobless rate above 10 percent. Given such "far-reaching effects," Fitch said it did not expect Congress to allow it to happen, echoing recent market optimism.

But Richard Franulovich, senior currency strategist at Westpac Securities in New York, said in a note that the positive conciliatory rhetoric over the "fiscal cliff" could easily come unstuck, while anything that is produced at the euro zone finance ministers' meeting is likely to be piecemeal.

"Given our read of the fiscal cliff and Greek risks we remain comfortable fading strength in risk assets," he said.

The euro zone's debt crisis saw Moody's cut France's government bond rating to Aa1 and keep its negative outlook, citing the country's uncertain fiscal outlook and deteriorating economic prospects.

France's downgrade sent the euro down 0.3 percent to $1.2777 from $1.2810, before it steadied to $1.2797, and also weighed on the euro against the yen.

Hiroshi Maeba, head of FX trading Japan for UBS in Tokyo, said the reaction to the downgrade was limited, as trading was getting lighter ahead of Thanksgiving weekend.

"Given the recent market rally, the rest of the week is likely to be spent on adjusting positions before the long weekend, with any uptick giving way to profit taking," he said.

Brent crude held steady above $111 a barrel on Tuesday, less than a dollar away from a one-month top hit in the previous session, on hopes over the U.S. budget crisis and supply worries triggered by tensions in the Middle East.

U.S. crude futures eased 0.3 percent to $89.06.

Spot gold was nearly flat at $1,732.05 an ounce.

With risk appetite recovering, credit market spreads on the iTraxx Asia ex-Japan investment-grade index tightened by 4 basis points.

Vancouver to host Davis Cup Canada-Spain tennis tie in February

Canada will be led at its Davis Cup tie vs. Spain by Milos Raonic, who has climbed to No. 13 in the world.

VANCOUVER ? Tennis Canada has decided to bring the Davis Cup back to Vancouver, which means a Canada vs. Spain matchup next February at UBC's Doug Mitchell Thunderbirds Sports Centre.

An official announcement will be made Monday at a news conference at UBC with Davis Cup captain Martin Laurendeau and Tennis Canada management.

Last February, Canada, playing in front of a boisterous crowd of 5,000, lost a Davis Cup tie to France at UBC, but then retained its spot in the 16-team World Group for 2013 by beating South Africa in Montreal in September.

Powerhouse Spain, able to draw on 11-time Grand Slam singles champion Rafael Nadal and current world No. 5 David Ferrer, have won the Davis Cup four times since 2006. But with Nadal sidelined with a knee injury, the Spaniards lost the 2012 title on Sunday, 3-2 to the Czech Republic.

Canada, which will want a hard, fast surface, will be led by Milos Raonic, who has climbed to No. 13 in the world. Raonic was criticized in some quarters last February when he pulled out of second-day play against the France with a minor knee injury.

State Demands $17.1 Million Payment from City of Cerritos | Hews ...

The California Department of Finance (Finance) has informed the City of Cerritos that Finance has completed its review of the Successor Agency to the Cerritos Redevelopment Agency Low and Moderate Income Housing Fund Due Diligence Review. Finance disagreed with the conclusions and Finance staff has demanded that the City make a cash payment of $17.1 million to the State of California.

The City strongly disagrees with the State?s findings and is requesting to Meet and Confer with Finance staff to ask the State to reconsider its decision. An independent auditor prepared the Successor Agency to the Cerritos Redevelopment Agency Low and Moderate Income Housing Fund Due Diligence Review. The purpose of the review was to determine the amount of cash and cash equivalents available from the Low and Moderate Income Housing Fund for distribution to the affected taxing agencies (including the City, County of Los Angeles and State).

The review concluded that no cash or cash equivalents were available for distribution. The review was approved by the Oversight Board of the Successor Agency to the Cerritos Redevelopment Agency and submitted to Finance on October 15, 2012. The City believes all of its actions were legal and appropriate, however the State has informed the City, ?HSC (Health and Safety Code) section 34177 (d) requires all unencumbered LMIHF [Low and Moderate Income Housing Fund] funds be remitted to the county auditor controller for distribution to the taxing entities.?

At the Meet and Confer with Finance staff, the City will present information which supports its position that the $17.1 million is not required to be transferred from the City to the other taxing entities. It is the City?s position that no payment is required at this time. The loss of $17.1 million would have a direct impact on the financial resources of the City, which will require City officials to closely evaluate future operating expenses. The loss would follow earlier raids by the State of the Agency?s funds.

In 2012, the State required the Successor Agency to the Cerritos Redevelopment Agency to pay $5,979,282 to the Los Angeles County Auditor. In addition, the State failed to make an estimated $8 million in property tax distribution payments to the Successor Agency to the Cerritos Redevelopment Agency from February through June 2012. The State also required the Cerritos Redevelopment Agency to make payments of $2,431,884 in 2011 and $11,812,007 in 2010 to the Los Angeles County Auditor as part of the ?Supplemental Educational Revenue Augmentation Fund? (SERAF) to help fill the State?s budget deficit. On February 1, 2012, the dissolution of all redevelopment agencies in California took effect as a result of the State?s actions. In the Fiscal Year 2011-2012, the Cerritos Redevelopment Agency had been projected to receive $31,527,790 in property tax increment, however the State took a large portion of those funds as a result of the dissolution of redevelopment agencies.

Lowe's 3Q net income climbs on fewer charges

(AP) ? Lowe's Cos.' said Monday that its third-quarter net income surged 76 percent, helped by lower costs and higher revenue, as the company's efforts to revamp its merchandise and prices appeared to be gaining traction.

Its adjusted earnings without charges and its revenue both beat Wall Street forecasts. Its shares rose more than 7 percent in morning trading Monday.

Lowe's has been retooling its pricing strategy, and last summer returned to offering permanent low prices on many items across the store, instead of offering fleeting discounts. But the changes have been slow to catch on, and last quarter Lowe's said it could take until the middle of next year to reap the benefits of the strategy.

"We are keenly focused on improving our core business," said CEO Robert A. Niblock. "Our level of execution is improving and we delivered solid results in the third quarter."

The results are also the latest indication that home-improvement retailers and other housing-market related companies are benefiting from the beginning of a rebound in the housing market, with home prices and home sales growth both improving. Last week rival Home Depot Inc. reported slightly higher third-quarter net income and the company raised its full-year forecast.

Home Depot also benefited from a surge in sales late in the quarter from Superstorm Sandy preparations. Lowe's did not point to any benefit from the storm in its earnings release.

Lowe's earned $396 million, or 35 cents per share, for the three months ended Nov. 2. That compares with $225 million, or 18 cents per share, a year ago.

The current quarter includes charges that lowered earnings by 5 cents per share. In the prior-year period, charges reduced earnings by 18 cents per share.

The adjusted earnings of 40 cents per share beat the 36 cents per share that analysts polled by FactSet predicted.

Revenue rose 2 percent to $12.07 billion from $11.85 billion. That also beat Wall Street's estimate of $11.93 billion.

Shares of Lowe's gained $2.37, or 7.4 percent, to $34.35 in morning trading after rising as high as $34.50 earlier in the session. That is its highest level since February 2007, according to FactSet.

Revenue at stores open at least a year, a key gauge of a retailer's health, increased 1.8 percent. At its U.S. stores, the metric climbed by the same percentage rate. This figure excludes results from stores recently opened or closed.

For fiscal 2012, Lowe's still expected earnings of about $1.64 per share and revenue to be approximately the same as 2011's $50.21 billion. Analysts forecast earnings of $1.66 per share on revenue of $50.1 billion.

Lowe's Cos., which is based in Mooresville, N.C., has 1,750 stores in the U.S., Canada and Mexico.
